Fresh appeal bid in city gang rape case

THREE men who were sentenced to a total of 18 years for abducting and raping a young mother in an Edinburgh tower block are having their case examined by a body set up to investigate miscarriages of justice.

Brian Meighan, Kevin Kane and David Pugh were found guilty in November 2000 of subjecting their 21-year-old victim to the sex attack in Moredun.

Last June, they failed in a bid to overturn their convictions. Meighan, 27, of Firrhill Drive; Kane, 22, of Fernieside Crescent; and Pugh, 26, of Fernieside Gardens, all Edinburgh, denied raping the woman, claiming she had consented to group sex.

They appealed on the grounds that judge Lady Paton had misdirected the jury, but appeal judge Lord Kingarth threw out the challenge.

The men continued to protest their innocence and submitted their case to the Scottish Criminal Cases Review Commission (SCCRC). It is expected to decide within weeks whether to refer the case to the Court of Criminal Appeal.

If that happens, and the appeal court upholds the challenge, the men would have their convictions quashed and be freed.

Their case is being closely watched by the Miscarriages of Justice Organisation (MOJO) Scotland, a charity set up last year.

It is understood that, since the appeal, two people have come forward claiming the girl told them she gave false evidence.

The commission is thought to have been anxious to speak to a witness who is seen by the convicted men's supporters as having potentially vital information on the case.

It is further believed the complainer was allowed to change a 14-page statement she gave to police, altering the place the rape was said to have taken place from the stairwell to one of the accused's flats.

John McManus, project co-ordinator with MOJO Scotland, said the three men appeared to have a strong case.

At the moment we certainly think there's a lot of questions to be asked. There's a very strong possibility these guys are innocent.

We never pursue a case if a convicted person lies once, but these guys have never changed their story.

A spokeswoman for the SCCRC today said: The commission's policy is that we won't say if we are looking at a case. We cannot comment on individual cases. The court originally heard the woman had been lured into entering a flat containing three strangers - Meighan, Kane and Pugh - after drinking with friends in the tower block.

She told the court they got into a conversation about sex and they asked if she had ever had three men in the same bed.

She said she got up to leave but was grabbed and taken into a bedroom, where she was raped.

But in a letter to the Evening News, Pugh, who has been kept at Peterhead Prison, claimed he, Meighan and Kane were the real victims.

The complainer came up to Brian Meighan's flat . . . on her own accord and we all had sexual contact with her.

He added: No force was used and certainly no crime was committed.

The SCCRC took over the power to refer cases back to the Appeal Court from the Scottish Secretary in 1999.

It has taken the process of considering whether a case should be re-heard out of the political process and into the hands of seven independent commissioners.

MOJO Scotland was set up by Paddy Hill, one of the Birmingham Six whose convictions for the murder of 21 people in two pubs were quashed by the Court of Appeal.

Gerald McClure, a senior partner of McClure Collins, which is representing two of the convicted men, said: The Scottish Criminal Cases Review Commission are making full inquiries into the application that has been made. A decision is anticipated in the next couple of months.
